Alternative Dispute Resolution (ADR)

Michigan ADR Services — Mediation and Arbitration

Whether among professionals, businesses or individuals, a dispute between parties can be costly and time consuming. In the business world, litigation can completely hinder routine business affairs — costing the business further expense. That is why many individuals and professionals prefer to avoid litigation and resolve disputes through mediation or arbitration.

At the law offices of Cooper & Riesterer, PLC, we strongly believe in alternative dispute resolution (ADR), such as mediation or arbitration. Our lawyers have a wealth of knowledge and experience in these matters and provide ADR services throughout Livingston County and southeast Michigan. Contact us to learn more about our arbitration and mediation services.

  • Arbitration: Arbitration is a form of alternative dispute resolution in which the parties agree to be bound by the decision of a neutral arbitrator. Arbitration is much quicker than trial as it avoids the need to wait for a trial date or the conclusion of an appeal. Once the arbitrator hears both sides, the arbitrator will render a decision and the matter is resolved. Usually arbitration decisions are binding (they cannot be appealed or set aside) and provides a final resolution of the dispute.
  • Mediation: Mediation is a non-binding form of alternative dispute resolution. Mediations are typically held on neutral ground and the parties come together in attempt to negotiate a settlement or agreement. A neutral third party (the mediator) facilitates negotiations; however, any resolution is determined by the parties involved. Mediation enables individuals to take an active approach to resolving their legal issues.

No matter how a dispute began, our attorneys work to avoid further escalation of legal disputes. We often represent clients in mediation or arbitration to resolve disputes before matters proceed to trial. Mediation and arbitration are usually quicker and less costly than litigation. Another benefit of mediation is that it can help parties avoid further hostility or conflict. When the parties will likely have future dealings, such as business partners, neighbors or ex-spouses, preserving an amicable relationship can be very important.
